The Blackout Defense: The Future is now for Criminals

The Blackout Defense is soon to be a staple of defense attorneys everywhere, and will be coming to a courtroom near you soon. In Black Run America, criminality is but the logical outcome of years of pent-up aggression to an unjust system that mandated the persecution of Black people.

In London, England murder was once a rarity, but now a permanent fixture of life in the capital of the United Kingdom. The culprits aren’t the sons and daughters of Albion, though. Perhaps the Blackout Defense will be exported to England to help those unfairly indicted once they reach a criminal trial.

Donnell Buckner was just a mild-mannered Black guy who was traversing his kitchen with the final destination being his refrigerator and a plate of cold fried chicken. What happened next is still in dispute, though what is established is that Mr. Buckner never had the opportunity to consume the fried chicken:

The killing happened in an instant, according to Donnell Buckner: three, maybe four shots fired in a time warp forged by a momentary loss of consciousness.

One moment he argued with his estranged wife, Buckner testified last week, the next she lay dying - blood on the walls of their Lehigh Street, Wilkes-Barre home and a .357 Magnum in his hand.

"I panicked and I ran," Buckner said, underscoring his contention that he blacked out just before last spring's shooting and never intended to harm his wife, Kewaii Rogers-Buckner.

Buckner's claim is a focal point of his defense and, according to psychiatric and legal experts, could mean the difference between guilt and innocence or 20 years in prison and a life sentence.

Attorney Elizabeth Kelley, of Cleveland, Ohio, said a "blackout" defense could insulate a defendant like Buckner from questions of pre-meditation and intent, undermining a prosecutor's ability to secure a first-degree murder conviction and a life sentence or the death penalty.

"Most often it's successful in terms of mitigation," Kelley said. "You can not defend the indefensible, you have to acknowledge that there was a crime, that there was a victim.

By the same token, you have to acknowledge before the court that your client did what he or she did only because they functioned differently than other normal people."

Buckner, 35, faces a mandatory life sentence if a Luzerne County judge convicts him of premeditated, first-degree murder.

He faces 20 to 40 years in prison if the judge, Tina Polachek Gartley, convicts him of third-degree murder.
The trial is scheduled to resume today, with testimony from Dr. John O'Brien, a Philadelphia psychiatrist who examined Buckner for prosecutors, and closing arguments.

Gartley, who is sitting in place of a jury, could begin deliberating her verdict by mid-afternoon.
Buckner's attorneys, William Ruzzo and Mark Singer, and the prosecutors, Ferentino and Frank McCabe, are under an order from Gartley not to make statements to the media and were unable to comment for this story.

Dr. Richard Fischbein, a psychiatrist who evaluated Buckner for his attorneys, said Buckner had been diagnosed with bipolar disorder but never reported blacking out until after the killing. Blackouts, Fischbein testified, are not usually associated with bipolar disorder.

Prosecutors are skeptical of Buckner's blackout claim and the assistant district attorney who cross-examined him, Jarrett Ferentino, attempted several times to bridge his memory gap. "Who shot your wife?" Ferentino asked.

"That's what happened that night," Buckner responded.
"You did it," Ferentino said, incredulous at Buckner's supposed blackout. "You shot her not once, not twice - three times. You don't remember her pleading for her life, that her last words were 'No, Smokey, stop!'?" "No, I don't," Buckner said. Stephen Dinwiddie, a forensic psychiatrist and professor at the University of Chicago, said blackouts like the one Buckner described are possible, but not necessarily linked to any specific psychiatric condition.

"It's very common for murder defendants to report amnesia for some or all parts of the murder," Dinwiddie said. "It's very difficult to tell: is this completely legitimate? Is the defendant not telling the truth about his memory? Or is it something in the middle?"

Buckner's supposed blackout could have been the loss of consciousness at the time of the incident, the path Bucker said his brain took, or a later loss of memory of the event because of head trauma or the excessive use of drugs or alcohol.

"You have to make the distinction between memory and awareness," Dinwiddie said. "The more complex the behavior, the more it looks like it's goal directed, the less plausible any argument that there was no awareness at the time is going to be."

Rogers-Buckner obtained an emergency protection-from-abuse order four days before the shooting, prohibiting Buckner from having contact with her or entering their home.
Buckner claimed he was not aware of the protection-from-abuse order when he entered the home, saying Rogers-Buckner invited him over to see their 9-year-old son.

Buckner said he entered the home through a back door and, before seeing his son, grabbed his .357 Magnum from a shelf behind a washing machine. He claimed he had heard investigators had obtained a search warrant for the home.

Buckner said he went to the refrigerator, pulled out leftover fried chicken, put it on a plate and into the microwave. As the food cooked, Buckner's son walked into the kitchen.

The boy smelled the chicken and wanted something to eat, Buckner said. Rogers-Buckner wanted the boy to go back to bed, Buckner said. The boy returned to bed and Buckner said he and his wife argued.

Then, he said, he blacked out.
Buckner's stepdaughter testified last week that she heard her mother pleading for Buckner to stop after Buckner fired the first gunshot. The girl recalled running downstairs after the third shot and, from the edge of the kitchen, seeing Buckner standing over her mother in the adjacent living room.

"I think he's trying to put the pieces together," Fischbein, the defense psychiatrist, said. "Why it happened. How it happened. He takes responsibility for what happened, but he doesn't know how it happened."

Though, fried chicken is once again seen as the catalyst for a harrowing scene that is being replicated all across America, confirming that this most disconcerting drama is becoming an alarming trend across the nation thanks to a fowl delicacy.

In France recently, a Black defendant attempted to utilize the burgeoning Righteous Black Anger defense for the crimes of raping numerous white women.

Well, criminals in America will soon embrace The Blackout Defense to ensure their absolution, though some could claim a Blackout is already occurring regarding criminal reporting.

The sins of the past come to haunt those in the present, even if those supplying the justice claim Blackout in their defense.

Sadly the color of crime is becoming more obvious by the day, but the efficacy of The Blackout Defense could make the new judges presiding over cases in America think twice before sentencing commences.

Literally! A SPEAR!! They were apparently arguing when he grabbed the spear know...CHUCKED it at her. I kid you not. Wonder if he'll use the blackout defense?

The term "blackout" is racist against black people. At its core, it refers to an absence of consciousness. It is inherently racist for white people, who oppress blacks by their nature, to refer to a "blackout" as a period of non-memory.

Why bother to remember to pay your bills when blacks will soon declare credit scores to be racist? Oh, you can't imagine? It is already in the works to prohibit credit scores from job eligibility... give it a few years.

What is next?

Someday soon, you can play poker with a black and win a hand. He will "black out" and decline to pay the pot. If you dissent, you will be rightfully labeled a racist. The only defense for a mentally competent defendant to a specific intent crime such as murder would be the defense of involuntary intoxication. Blackout does not mean insanity or incompetence, just a lack of memory. Nonetheless, lack of memory does not equate to legal incompetence to form specific intent. Bipolar disorder is irrelevant in court.

But this could go the way of the Knoxville Horror. In Knoxville, the population is 16% black, but due to the "high profile" nature of the case, the jury pool was selected from a town clear across the state with > 50% black pop.! "High profile"? Stuff Black People Don't Like? How bout honoring their legal responsibilities as unbiased jurors and their duties of good citizenship. Blacks' notoriously poor citizenship is evidenced by epidemic jury nullification, not just insane crime rates and social welfare vampirism. The all black jury which acquitted a clearly guilty O.J. is just one example of what goes on in courtrooms every day in the name of servitude to our new black slave masters. Another great example is how Obammy and the equally unqualified Eric Holder forced the Votings Rights Section of the DOJ to abandon the prosecutions against the New Black Panther Party for the most blatant violations of federal election law since the Voting Rights Act was passed. The 5 DOJ attorneys who brought the complaint were ordered by the Obammy administration to illegally refuse to comply with federal subpoenas. Several attorneys were fired for trying to press the case.

The entire time I've been posting I've been declaring that black people are indeed responsible for themselves. I have also been pointing out that, even though this is true, it becomes much harder to care for yourself when you have enemies surrounding you, mocking every slight or perceived misstep, engineering deceptive practices and institutions aimed at destabilizing your communities and promoting ignorance and violence to turn a few quick bucks (provided by a predominantly white audience).

It's quite simple, really. I am aware, however, that I am writing this (in part) to those same people now. Ironic. However, each one teach one. So:

Malcolm X’s home was firebombed; not only was the perpetrator never caught, but the police actually blamed Malcolm and claimed he firebombed his own house to make it look as if he was being targeted by someone. In fact, Malcolm had been targeted for heavy surveillance -- one of his own bodyguards was actually an undercover agent for BOSSI, New York City’s organized crime and anti-Communist unit. BOSSI was being pressured by the FBI to infiltrate the Organization of Afro-American Unity, which was set up by Malcolm X after he broke with the Nation of Islam.

It is this undercover cop that is often seen in the photographs giving “CPR” to Malcolm X, which, as any first-year medical student will tell you, is the worst thing you can do for a person with as many massive chest wounds as Malcolm suffered. It is also worth noting that the treasurer of the Nation of Islam at this time, James Ali, was a very high-placed informant for the FBI. Interestingly, this fact was first discovered by an author who later died when the brakes on his car failed while he was driving to a studio where he was set to begin shooting a film documenting the conspiracy surrounding Malcolm X’s assassination.

Ali, openly hostile to Malcolm X, was seen at a rehearsal speech given by Malcolm just days before he was killed -- at which a scuffle broke out, similar to the one that would break out on February 21, 1965, distracting the crowd just long enough for two men to walk up and shoot Malcolm X at point blank range. Strangely enough, all of the other speakers that night had canceled at the last moment, leaving Malcolm to carry the evening. It seems clear that nothing may have been able to save him, but Columbia Presbyterian Hospital, one of the finest medical institutions in the city, did not respond to the request for help despite being right across the street from where Malcolm was killed. In the end, Malcolm’s own aides had to go across the street, bring over a stretcher, and then wheel him back over before they received any help at all.

As a final footnote, one of Malcolm’s top aides went to the FBI about ten days after the assassination and told them that he felt there was a larger conspiracy, incorporating elements of the U.S. government, involved in Malcolm’s death. He was found dead a few days later at the age of 32 in his Boston apartment. Initially the death was classified a suicide, then it was changed to a drug overdose, and finally it was ruled natural causes."

Malcolm X was assassinated after his hajj, after his pilgrimage to Mecca, and after he renounced all forms of racism and became repentant of his ways during the time he served as the mouthpiece of Elijah Muhammad, and thus far more dangerous to the establishments of both white America and the Nation of Islam, which was rife with FBI COINTELPRO plants. Christianity is about truth and redemption, salvation given from Christ Jesus. "Love and tolerance" is fag speak. God does not tolerate sin. He does not love sin. It was not merely a speculative statement. It was an attempt at justification. And you are perfectly free to voice your racist opinion. I just object to the hypocritical way you assume you have the moral high ground, and thus your racial assessments and sweeping generalizations are somehow appropriate while mine are dismissed as hate-based rhetoric. Say what you really think, I don't mind. It merely proves we are all "racist". Embrace your destiny, do not fight it.

It is not my place to judge your intangible motivations, nor do I care. It is the internet after all, and all I have here to judge are your words. It is upon these that I base my judgment. And my judgment is that you are very concerned with race, and your concern for race appears to be singularly focused upon interactions that affect your race in particular. There is nothing wrong with that. I actually feel the same way about my own race.

All races will always universally share that commonality. Upon that fact must all racial policies be based. Anything else and we are just farting into a hurricane.

Please spare us your righteous speech on how christianity really is. I've never seen a christian use the word "fag" and I'm sure God wouldn't appreciate a christian whose purpose is to serve him and spread the word of God. You are an example of how christians act and truthfully you're making them not look to good. So do spare your little hypocritical speech of what God tolerates because if you think he tolerates your comment, you're sadly mistaken.

Get a grip and learn how to take constructive criticism for once.
